TNL Coach Released - Mistrial Declared

Sam They don't want to consider that, it makes them too uncomfortable to think that they allowed Facione access to their DD's for all this time. The Kool Aid must be awesome. They must live their lives with their heads in the sand. They will agree that Facione's behavior is very questionable, to say the least, but they don't want to believe that they allowed their DD's to go over to his house at all times of the day and night and allowed their DD's to commiserate with him, texting all the time, about their life's problems. They just don't want to consider that maybe their DD's did the deed with him, right under their noses.

Hmmm.... amazing how many people rushed to judgment on this case, and then totally discount the Jury's deadlock - all it takes is one person to have a hung jury - much less the Judge's statements when he dismissed the charges.

Once again, there was NO content from text messages available to be introduced as evidence. Simply the phone company logs of text messages sent or received....

I have known the coach very well the past several years, and spent a lot of time with him both in and out of softball. I find it hard to believe that if he had a pattern of sexual misconduct with other players over the years that it would not have come in the open.

If you check the local San Diego newspaper archives, at least two or three local teachers and coaches have taken plea bargain felony deals in their own sexual misconduct cases. These deals include jail time - one case recently was an Escondido High School teacher who also coaches the girls water polo team.

Defendants do not accept plea bargain offers from the prosecution unless they are guilty and they don't want to risk more jail time if the case goes to the jury....

Why would the Deputy DA in this case offer a plea bargain down to a misdemeanor after she put on her FIRST witness, the Police Detective? Because the case was too thin to begin with and should not have been filed.... The Deputy DA mailed the case in after she found out the victim had lied through her teeth....

Again, a very sad and unfortunate situation for all involved.... And, as for the defendant spending money on a competent defense team, if your liberty and freedom was at stake, wouldn't you want the best representation you could find? Imagine your son or daughter in court as a defendant facing prison time and a lifetime label as a sex offender. Very serious stuff. And, I would not be venturing my opinion here if I had not sat through the entire trial and all the previous arraignment, preliminary hearings, etc....

It sounds like you are big on the premise "innocent until proven guilty". I think we all are, for the most part. Do you agree that OJ Simpson got off with the aid of good lawyers, a questionable jury, and that the prosecution could of done a better job? I think most people feel that way. Yes, I know, murder and having sex with a minor isn't the same, but it's still a very serious concern in the softball community, where we all want to believe that our DD's are safe with their coach's.
Facione got off with a combination of getting the best defense that money could buy and the prosecution not doing a great job. He wasn't found innocent, like OJ. Facione displays all the components of a person with very questionable judgement, morals and ethics. He is a 37 year old man that likes to promote texting between his players and himself, not to tell him they will miss a practice, but to tell him about their life's problems. He invites kids over to his house. He likes his players to pour out their problems to him. He wants to be their "daddies". Is this normal behavior for a softball coach? He has girls in his room, takes a shower and walks out into the room with a towel around his waist???? Does this sound normal to you?
I really think all the TNL parents that support Facione are in denial. They just don't want to think they could make that big of a mistake, so they don't believe it. They stay in denial. Must be the TNL Kool Aid.

just as you don't want to consider that this young lady is not very credible, and quite possibly a liar, and that before you hang a label on a young man of being a sexual predator you better darn well be sure about that. The fact that we are not willing to do that based on this young ladies word is nothing more than giving this coach the benefit of the doubt until we have good reason not too, and this young lady is not good reason not too.

Again, our opinions are just that, and what we do with our kids is our business, now you and I both believe that these actions where too much. However, these parents did not, so to belittle their decision or to belittle their ability to parent based on the fact that you would have done it differently is a bit condescending in my book. I'm not here to judge these parents, and if they trusted this coach, then so be it, because until this point there is no evidence that there has been any wrong doing on by this coach, all that has been offered is acquisitions and opinions which aint proof of nothin.

My goodness, all of them. Now this is totally off the charts and cross the line, to insult all of the kids who have played for this guy by insinuating that they are all hiding the fact that they slept with him because this one young lady who has been untruthful says something shady happened. Are you serious? Wow, that is crazy, what kool laid are you drinking, scratch that, what are you smoking? There is certainly no evidence of this guy having any type of history of sleeping with his players and to come on here and suggest that is beyond inflammatory and flat out disrespectful to every young lady who is off playing college ball currently that has played for him.

You are the one's who are discounting the opinions of 4 jurors who voted guilty...with admittedly slim evidence....imagine if they had actually seen the text messages sent.

The DA offered the plea deal only after the judge had eviscerated the case by refusing to allow the text of the text messages.

Yep, I agree that OJ was certainly involved, in some form or fashion. I also believe that in a rage of border line racism and rush to judgment the LA police department planted evidence which ironically was the reason he eventually was set free. So while yes the system doesn't work at all times, it is none the less our system, and in this case not following the rules of engagement cost the LA police department and the district attorneys office a chance to give justice to those families.

Yes, I will admit, he was too close to his players , but does that fact alone make him automatically guilty of this crime?

Again this happens, his only mistake was allowing this young lady to visit his home, that is where he blew it. But players talk to their coaches all the time about things they cant bring up at home, nothing out of the ordinary about that.

No, that wouldn't be, but that is your opinion that he wants to do all those things, I don't believe I ever heard anyone say that he wants to be their daddies, that is your opinion of his actions. That may or not be his motivation, maybe he got caught up trying to be too much of the cool, hip, coach, and it bit him right in the rear.

No, and if indeed this in fact happened in the manner that you state it, it was way over the line, and border line criminal. However, I don't believe we have any proof of this either, just hear say and accusations from people that may or may not have been there.

Or maybe they feel like they know this guy, and they know this young lady, and they have made a decision based on those relationships as to who they believe is more credible.

I understand CF is leaving for North Carolina. Has he left yet? And I hope he does not conduct himself the same way he did here. I know he is going to a college to coach. Is it softball or baseball?

Why do you think he is going to NC? Nobody knows about his track record here.
