HBP 3rd strike revisited

Same scenario, 2 strikes on batter, batter swings at pitch, misses, and is HBP. Umpire calls it a D3K live ball and runner advances to 1st. He said in that scenario it is not a dead ball play. When I asked him between innings he said it was just covered in their umpire training that this is not a dead ball unless the batter's body was in the strike zone when she was hit.
Any input?

2008 ASA Rulebook
7.4.H and EFFECT: Section 4 F-L say it is a strike and a dead ball.
7.6.A says the batter is out.

I got the same thing, ASA 2010: dead ball, strike 3, out.

Anytime a pitch touches a batter the ball is dead.

The result of the play might be an award of first base (batter unavoidably hit by pitch outside of the strike zone), no base award and a ball added to the count (batter intentionally touches pitch or allows pitch to touch her outside of the strike zone) or no base award and a strike (batter is touched by pitch within the strike zone, or prevents the pitch from entering the strike zone, or is touched by pitch while offering at it).

But, in ALL cases the ball is immediately dead when the pitch touches the batter.

Would the ruling stated above be changed to foul ball if the batter was hit on the hands while swinging and missing the ball?

Perhaps the game's oldest and most often repeated RULE MYTH has popped up here twice in the past week- and the season hasn't even started yet (for most of us)!

The hands are part of the batter- or the batter's "person"- and a pitch striking the hands is treated exactly the same as one striking an arm, a leg or a noggin. So the next time somebody tries to pass off the old saw that "the hands are part of the bat"...you'll know better than that!

Not arguing w/ the rule (I already knew of it) but wondering the 'intent' of the call. Is it because the attempt to swing was made (probably putting the batter in the way of the pitched ball) and thereby trumps the fact that the batter is struck by the pitch (as opposed to a batter taking all the way and getting beaned)?
What I am not clear on is the same scenario but batter has only 1 strike at the time--is this a 3rd strike-specific rule? Had just this happen last summer and resulted in a confab by the umps but for the life of me cannot remember the outcome...

If the batter has less than 2 strikes, it is just a dead ball strike.

What is the correct call if the batter swings and the ball goes off the hands into fair territory? Is it a dead ball strike or a batted ball?
