So read below.
Courts have ruled in many cases throughout the United States, that outside sources of funding have no bearing on Title IX. The following is taken from an article:
A school cannot evade its responsibility to treat its male and female athletes equally by pointing to outside sources as the cause of unequal treatment. As one court has explained, “Once a (school) receives a monetary donation, the funds become public money, subject to Title IX’s legal obligations in their disbursement.” Chalenor v. Univ. of North Dakota, 291 F.3d 1042, 1048. Though they may accept such gifts, schools bear the ultimate responsibility of ensuring that boys’ and girls’ teams are treated equally.
"At CPHS, maintenance of the softball facility was particularly problematic because of the lack of perimeter fencing, the use of the field by physical education classes for kickball, softball and soccer, and use by the girls' field hockey and soccer programs," Lorenz wrote. "In contrast, the boys' baseball field was not used for physical education classes or for any other uses."
My comments:
This case IMO, shows that, while your concerns are valid, according to title IX, they have no bearing. The fact that the girls must play on substandard fields, due to the fact your district would have issues with boys soccer fields has no bearing on being in compliance with title IX. The fact that your baseball fields are fenced in and offer baseball only use, while the girls must share their fields, which also requires them to have no fencing, is a direct violation of title IX according to the above referenced case. Essentially, the girls softball programs are being asked to use substandard facilities to maintain the field use for other programs, while the boys must face no such burden.
The courts do not care that money came from booster clubs, or was raised by a baseball coach. If you do any research on this at all, you will see that the fact your schools baseball teams were given money from boosters to install a scoreboard does not abdicate the districts responsibility to do the same for the girls.
So you can side with whomever you want, the courts have already spoken on these issues, and schools have lost. Trust me, they arent canceling programs, but if you think the girls should suck it up on piece of shit fields while the boys play on minor league facilities(because that is the way it has always been)... Im sorry, but you can suck wind:)
