Just a FYI, a lot of yall were so supportive back 18 months ago, when my son was assaulted. You may be interested to know the bad guy finally left for prison 6 days ago. He was sentenced to 3 years in the texas prison system. He took a plea deal - in our town, I thought he was going to walk. A guy got two years for killing a guy 3 months after Erik was attacked - same deal, sucker punched a guy - the only difference in the two cases that I could tell from reading about his case was both were considered intoxicated. The guy who attacked my son , was out on bond (which was totally bs anyway) and he and another guy, apparently attempted to rob a Whataburger (texas hamburger chain) 2 months ago , and he was caught, found to be drunk and had prescription drugs for which he had no prescription, so three charges on that that if we understand , he still has to be sentenced to. The charge that he was sentenced for on my son's case was attempted murder.

It just seems like he got off easy, but at least they caught him and he is going to do some Texas prison time. Has your son made a full recovery?

He is way ahead of schedule - most of the time he is fine. He has some pain issues, as his skull heals, he has the metal - i think its titanium - plate over the broken area, this is the left side of his head. His skull was fractured by the guys fist, then again when he hit the ground. When I first saw him that night, they were prepping him for surgery, he was bleeding from both ears, if things werent already very scary, that's what did it for me. I just got ready for the worst , seeing that.

He has no memory issues that he tells me about, during the recovery period, he went through some depression issues - which I think his 14 little boys (his football team) probably did more to pull him through than the medication. He is on no medication anymore.

Except for the depressed area of the left side of his head and the fairly large scar, if you ran into him, you wouldnt know he had been hurt, in my opinion. He grows his hair much longer now to hide all of that - and almost always wears a cap, but he did that before.

Of the people we met who had been through this, we belong to a group called TBI Survivors Family, he is the one who has come back the most. One of the things he does now is meets with other TBI victims at the hospital and sometimes I meet with their families , to tell them what to expect, stuff like that. Other people did it for us, when Erik was in the hospital.

The Grace of God that night and the love of your family during the recovery is the reason he is doing so well. I didn't realize how hurt he was that night.

The call that night was the nightmare call to a parent - "you need to hurry, I dont know how long he has" - that was the call from my brother , he is an ER doc.

Donnie, I know from speaking with you before and because you are such a good man that you prefer to move forward and not dwell on the past and pointless thoughts of revenge and justice.

That said I will just add that like everyone else here in your HB family I am extremely happy that this difficult chapter of your son and entire family's lives is closing and that this book looks like it has about as good an ending as it can have,

Weird how the legal system works.

My son in law was assaulted by an individual with a shotgun during dove season some years ago. The guy was clearly trespassing and pretty much a maniac. At the trial, my son in law knew that the guy had several other pending legal cases going but the jury was not allowed to hear "prejudicial" information like that lest they be swayed. Of course the accused denied everything and tried to look like a boy scout who had a bad day. After the jury let him off the hook, they were told that this guy had two other similar pending court cases. I was told that the jury was highly pissed off that they bought into the defendants legal strategy with some being brought to tears in frustration. Didn't seem like justice was served.

I'm glad to hear that your guy got tagged with something that will stick on him

Unbelievable nonsense in the "legal" system. Had this pos not committed another offense, I believe he would have walked too.

We've had a high-profile case here where a Giants fan, Bryan Stow, was severely beaten following the Dodgers 2011 season opener. It's interesting to see the difference in charges and sentences between the 2 cases. Stow's attackers pleaded guilty to mayhem, assault, battery and other counts. The principal attacker was sentenced to 8 years and the other one received 4 years.

Unfortunately, the sentences in both cases only take the dirtbags off the streets for a period of time. They'll likely be a danger to society after they get out. Hopefully, no one else will be seriously harmed or killed before they're off the streets forever.
