Another safety base question

ASA rules:
R1 is on 1B. Batter pops up in foul territory. F3 catches the ball and tags the colored portion of the base beating R1 diving back to the white portion of the bag.

Call on the field is: batter out but R1 is safe because F3 can only use the colored portion of the bag on a throw from foul territory on the batter.

The rule seems to say that the defense can use either side of the bag, but it also refers to the batter runner, which R1 is not...

Whats the call?

I will have to double check, or if MTR checks in he can verify, but as I recall in tag up situations the runner or the fielder may use either portion of the base.

The rules requiring the offense and defense to use a specific portion of the double-base only applies when there is a play on the batter-runner.

In this instance, that is not the case therefore the offense and defense may use any portion of the double-base to execute a play.
